An application for judicial review of decisions not to prosecute former undercover police officer for the offences of rape, indecent assault, procurement of sexual intercourse and misconduct in public office. Overall, the CPS lawyer was entitled to form the evaluative judgement that a jury would be unlikely to draw the necessary inference of mens rea on the facts.
