Re:

The judgment was handed down on 3 June 2026 in a libel claim arising from allegations of sexual assault made by the defendant about the claimant, which were set out in two emails sent to university staff as part of an internal welfare process.

The court dismissed the claimant’s application to strike out, or obtain summary judgment on, the defendant’s defence of truth. The court found that the fact that the defendant had no independent recollection of the sexual assault did not mean she would be unable to prove the substantial truth of the allegation at trial.

Kirsten Sjøvoll and Mariyam Kamil acted for the Defendant, instructed by Freeths LLP.
