Decision to proscribe Palestine Action unlawful

Published:

The High Court has today held that the decision to proscribe the direct-action group Palestine Action under terrorism powers is unlawful.

The Court found that the Home Secretary failed to comply with her own policy when making the decision to proscribe Palestine Action and that proscription breached the rights of freedom of expression, assembly and association protected by Articles 10 and 11 of the European Convention on Human Rights.

The parties have until 20 February 2026 to make submissions on relief and the proscription order remains in force pending further order.

Raza Husain KC and Blinne Ní Ghrálaigh KC acted for the Claimant, Huda Ammori, instructed by Kelly’s Solicitors and Birnberg Peirce. They led Owen Greenhall and Audrey Cherryl Mogan of Garden Court Chambers, Mira Hammad and Rosalind Burgin of Garden Court North and Paul Luckhurst, Grant Kynaston and Rayan Fakhoury of Blackstone Chambers.

Jesse Nicholls was a Special Advocate for the Claimant.

Jessica Jones and Rosalind Comyn acted for the Second and Third interveners, Amnesty International UK and Liberty, instructed by Deighton Pierce Glynn and Liberty. They were led by Tom Hickman KC of Blackstone Chambers.

The decision of Lady Justice Sharp, Mr Justice Swift and Mrs Justice Steyn is available here.
