New publication – ‘Restrictions on Open Justice: A guide for public law practitioners’

Published:

Eleanor Mitchell and Aidan Wills have written a first-of-its-kind guide: ‘Restrictions on Open Justice: A guide for public law practitioners‘ – an accessible and user-friendly practical resource, tailored to the public law context.

Public lawyers are often faced with questions about anonymity and related restrictions on open justice – most often when clients or witnesses fear their identity or sensitive information becoming public in connection with a claim. As courts become increasingly alert to the importance of open justice and increasingly rigorous in their approach, it is more important than ever to have a sound basic framework for approaching these issues.

Now available online, this new guide covers the types of restrictions that can be sought; the practicalities of making these applications; and the rules and principles courts will apply in determining them.
