Carter Chim, a leading authority in Hong Kong Competition Law, is recognised as a Tier 1 Leading Junior by The Legal 500 (Legalease) since its Hong Kong Bar rankings inception in 2021.

Carter’s expertise is backed by an illustrious educational background, having read Competition Law at King’s College London, courtesy of the British Chevening Postgraduate Scholarship. He graduated with distinction in 2011. From 2015 to 2016, he served as Legal Counsel to the Competition Commission in Hong Kong, during which he further deepened his knowledge in the field, earning a Postgraduate Diploma in Economics for Competition Law from King’s College London. His tenure was marked by his appointment as the first case manager for the Competition Commission, leading its first public enforcement action in Competition Commission v Nutanix Hong Kong Ltd v Others (CTEA 1/2017).

In 2016, Carter resumed his practice at Denis Chang’s Chambers, focusing on competition matters. He has represented a broad spectrum of clients, including respondents in high-profile cases such as Competition Commission v W Hing Construction Co Ltd and Others (CTEA 2/2017), Competition Commission v TH Lee Book Co Ltd and Others (CTEA 2/2020), Competition Commission v Linde HKO and Others (CTEA 3/2020), and Competition Commission v Multisoft Limited and Others (CTEA 1/2023).

Beyond his legal practice, Carter has made significant contributions to academia. He lectured in Competition Law at The Chinese University of Hong Kong between 2016 and 2019, and subsequently held a senior lecturing position at The University of Hong Kong from 2019 to 2024. From 2018 to 2022, he was appointed as a non-governmental advisor to the International Competition Network. As of now, he holds the position of Vice-Chairman of the Hong Kong Bar Association’s Committee on Competition Law.

Carter Chim is now set to bring his considerable expertise and wealth of experience to the English Bar, ready to make his mark in the London legal profession.

Carter played a key role in several landmark constitutional and administrative law cases before the Hong Kong Court of Final Appeal.  Notable cases include:

  • Secretary for Justice v Leung Kwok Hung [2021] HKCFA 32 – addressed the extent of parliamentary privilege for Legislative Council members during proceedings.
  • Leung Kwok Hung v President of the Legislative Council (No 1) (2014) 17 HKCFAR 689 – examined the Legislative Council’s autonomy in managing its internal affairs.
  • Leung Kwok Hung v President of the Legislative Council (No 2) (2014) 17 HKCFAR 841 – clarified legal principles surrounding costs in judicial review applications.
  • Ho Chun Yan, Albert v Leung Chun Ying (2013) 16 HKCFAR 735 – questioned the legality of the 2012 Chief Executive Election.

He also successfully represented the defendants in Turbo Top Ltd v Lee Cheuk Yan & Ors [2013] 3 HKLRD 41, where the court denied an interlocutory injunction aimed at stopping protests and the erection of temporary structures in a public space.

In addition to his litigation work, Carter has taught constitutional and administrative law at several Hong Kong universities:

  • City University of Hong Kong (2014–2015)
  • Chinese University of Hong Kong (2016–2019)

Carter achieved successful outcomes for defendants in key criminal cases before the Hong Kong Court of Final Appeal, including:

  • HKSAR v Chow Nok Hang & Anor (2013) 16 HKCFAR 837 – clarified the elements of the offence of “disorder in public places” under section 17B of the Public Order Ordinance.
  • HKSAR v Lo Kin Sun (2021) 24 HKCFAR 11 – established that the defendant’s lack of legal representation during trial constituted a breach of fair trial rights, rendering the conviction unsafe.

He also acted for the Prosecution in the high-profile case HKSAR v Raphael Hui & Ors (HCCC 98/2013), which dealt with misconduct in public office and bribery. Later, he successfully defended a defendant in another misconduct case: HKSAR v Leung Kwok Hung (DCCC 546/2016).

When practising in Hong Kong, Carter frequently appeared in the Magistrates’ courts, both on behalf of the prosecution and as a duty lawyer for the defence.

Carter’s practice includes a broad range of civil matters, with regular instructions in:

  • Winding-up petitions, including representing the successful petitioner in Re Yuan Tong Global Financial Group Ltd [2021] HKCFI 1534
  • Property disputes
  • Water leakage claims
  • Discrimination cases

Additionally, his expertise in property and general civil litigation led to his appointment as Senior Lecturer at the Faculty of Law, The University of Hong Kong (2019–2024).

Carter is experienced in employment and discrimination practices in Hong Kong. After acting for members of a trade union in a landmark case Turbo Top Ltd v Lee Cheuk Yan & Ors [2013] 3 HKLRD 41, Carter was invited to provide legal training to the Labour Department of the Hong Kong Government in 2016-2024. He also acted for insurance agents against one of the biggest insurance companies on employment law and discrimination law matters. During his tenure as a Senior Lecturer of the Faculty of Law of The University of Hong Kong in 2019-2024, he provided pro bono legal advice on employment law and discrimination law in numerous cases through the Clinical Legal Education programme.
