Zoe Leventhal and Emma Foubister have contributed two case notes for the Discrimination Law Association’s Briefings.
The first is on R (on the application of DMA, AHK, BK and ELN) & R (on the application of AA) v Secretary of State for the Home Department, where the High Court found that the Secretary of State’s approach to her duty to provide accommodation for destitute asylum seekers was unlawful, and constituted disability discrimination, a breach of the duty to make reasonable adjustments and a breach of the PSED.

The second is SH v Norfolk County Council, where the High Court found that the council’s care charging policy was unlawful and discriminated against severely disabled people who have higher care needs and face significant barriers to work. The differential impact of the policy was manifestly without reasonable foundation.
