Prize law: Unjustifiable in the twenty-first century? Interview with Professor Andrew Clapham

Published:

Prof. Andrew Clapham was invited to share his insights on Prize Law in the International Review of the Red Cross, published by Cambridge University Press on behalf of the International Committee of the Red Cross.

In the interview, Andrew discusses the role of prize law in modern naval warfare, questioning its continued validity. He explores how the traditional right to seize ships and cargo conflicts with contemporary international law, including the UN Charter, and considers its impact on neutral shipping, civilian protection, and global trade. He also addresses the lack of justification for treating property at sea differently from land and critiques the idea of maintaining or reviving prize courts, ultimately arguing that prize law is no longer appropriate today.
