Brexit and Asset Recovery – Could Brexit Lead to Monpede?
During the referendum campaign there were a number of suggestions about what the UK’s role might be if it left the EU. One suggestion was that it might become an Offshore Financial Centre (OFC) for the remaining Member States. If the UK were to fall outside the various Directives and Regulations governing judicial co-operation in asset recovery, it might become an attractive place for those looking to park or even shield money or assets, leading to a stampede of illicit capital and stolen assets from the continent. This short series of articles considers the question in both the civil and criminal jurisdictions, not only in the context of EU law but also in the context of the various international and supranational instruments to which the UK will remain a signatory regardless of Brexit, and also asks how much of an effect Brexit need have in practice.”
