Toby Fisher co-authors opinion for Coal Action Network


Toby Fisher has co-authored an opinion for Coal Action Network on the unlawful mining of coal by Merthyr (South Wales) Limited at Ffos-y-Fran. The greenhouse gas emissions attributable to the unlawful coal mining are comparable to the emissions of 155,000 people in Wales.

The opinion concludes that the historic failures of Merthyr Tydfil Borough County Council and the Welsh Ministers to bring the unlawful activity to an end were arguably unlawful failures and constituted maladministration for the purposes of the Public Services Ombudsman (Wales) Act 2019. The opinion notes that any failure by the Council and/or Welsh Ministers to serve a stop notice on the operator requiring the immediate end to the unlawful coaling would be vulnerable to successful legal challenge.
