On 12 February 2021 the government announced that the Restriction of Public Sector Exit Payments Regulations 2020 are to be revoked. The Regulations set a £95,000 cap on exit payments in the public sector.
Claire Darwin acted for the National Union of Journalists in the judicial review proceedings challenging the lawfulness of the Regulations which was due to be heard from 24-26 March 2021. Guidance issued by the Treasury on Friday suggests that employers should compensate any employees affected by the Regulations during the short period in which they were in force.
