Paul Nicholls QC yesterday secured an injunction to prevent an election taking place for a council seat in Wigan. The election had been called on the basis that the council said that a councillor had resigned, but Paul argued that he had not resigned, that there had never been a vacancy and that therefore the returning officer had acted outside her powers by calling an election. The day before the election was to be held, the High Court in Manchester agreed that an injunction should be granted preventing the election taking place.
