On Tuesday 20 December the English language testing case was featured on Channel 4 News. Mohammad Mohibullah a foreign student who had his right to stay in the UK cancelled by the Home Office after his English proficiency test was deemed invalid had this decision quashed in a landmark ruling. The ruling is significant because it found the Home Office was guilty of an abuse of power, having effectively bullied Mr Mohibullah’s college into withdrawing him from his course, rather than taking an immigration decision that gave rise to rights of appeal enabling Mr Mohibullah to challenge the finding reached. The ruling could impact on other foreign students who have had their visas cancelled in this way. Nick Armstrong was instructed by Salima Budhani and Farhana Patel of Bindmans and appeared for Mr Mohibullah. To view the programme, please click here.
