The Administrative Court held in R (Binder) v. Secretary of State for Work and Pensions [2022] EWHC 105 (Admin) that the National Disability Strategy was unlawful, as the UK Disability Survey that informed it amounted to a consultation exercise. The requirements of the Gunning principles had not been met and, as such, the Strategy was declared to be unlawful.

Sarah Hannett QC acted for the Secretary of State, leading Emily Wilsdon (Temple Garden Chambers).
