In the light of the EU Referendum, Jessica Simor QC, Rhodri Thompson QC and Helen Mountfield QC are appearing in three related claims concerning the UK constitutional requirements for withdrawal from the EU. Following on from a directions hearing today before Leveson LJ and Cranston J, the case will be heard by the Lord Chief Justice in October with a view to allowing a possible ‘leapfrog’ appeal to the Supreme Court before the end of the year, when the Government has indicated that it may wish to notify the EU of its intention to withdraw. The cases raise fundamental issues concerning the relationship between Parliament and the Executive and the scope of the royal prerogative in respect of EU law: see http://www.bbc.co.uk/news/uk-politics-36834743.
