The Judicial Committee of the Privy Council (JCPC) will sit in the Cayman Islands from 15-18 November 2022. This is the first JCPC sitting in a UK Overseas Territory.
The appeal raises several issues including whether the Grand Court of the Cayman Islands has jurisdiction to hold a closed hearing.
The appellant was transferred from HMP Northward in the Cayman Islands to a high security prison in England without notice or the opportunity to make representation prior to his transfer. The appellant has sought the application of the Cayman Bill of Rights to decisions under the 1884 Act and will argue that the decision-making process was unfair, they will further challenge the legality of the 1884 Act framework.
