Jessica Simor QC sends letter and legal Opinion of 3 QCs to Prime Minister confirming advice PM is understood to have received that Article 50 notification is unilaterally revocable

Published:

Following the Prime Minister’s refusal to release legal advice it is understood that she received, Jessica Simor QC has written to the PM enclosing a legal Opinion on the revocability of Article 50 of the Treaty on the Functioning of the European Union (TFEU).

The letter, produced by Jessica, and the legal opinion, written jointly by Jessica, Marie Demetriou QC (Brick Court Chambers) and Tim Ward QC (Monckton Chambers) addresses the extremely important issue of whether Article 50 would allow for revocation of the United Kingdom’s intention to leave the European Union, allowing the UK to remain in the EU on its current privileged terms. They conclude that Article 50 can be withdrawn before 29 March 2019 without the need to seek the agreement of the other EU member states and that if this happens the UK would retain its privileges.
