The Home Secretary yesterday published a previously secret Direction to the Intelligence Services Commissioner and Investigatory Powers Commissioner. The Direction requires the Commissioner to “keep under review the application of the Security Service guidelines on the use of agents who participate in criminality and the authorisations issued in accordance with them”. The Direction is the subject of a case brought by Privacy International and Reprieve in the Investigatory Powers Tribunal. Jonathan Glasson QC is instructed as Counsel to the Tribunal in that case.
