High Court strikes out representative action on behalf of class of 1.6 million individuals

The High Court has struck out a representative action for the tort of misuse of private information brought on behalf of a class of approximately 1.6 million individuals.

Mrs Justice Heather Williams held that, applying the principles concerning the representative action procedure established by the Supreme Court in Lloyd v Google [2022] A 1217, the representative action was bound to fail. She therefore struck out the claim and entered summary judgment in favour of the defendants.

Antony White KC and Edward Craven represented the successful defendants in these proceedings and in Lloyd v Google.
