Raymond Lee is a member of the Windrush generation. When he arrived in the UK on 29 July 1999, he was detained and forcibly returned to Jamaica, instead of being considered for entry as a returning resident under the Immigration Rules then in force. In 2019, he applied for payment under the Windrush Compensation Scheme, but the Home Secretary refused his application.

In R (Lee) v Secretary of State for the Home Department [2025] EWHC 519 (Admin), the Administrative Court quashed the Home Secretary’s refusal to pay compensation. The Home Secretary had failed to ask the right question, namely how the applicable Immigration Rules should have been applied to Mr Lee in 1999.

Chris Buttler KC represented Raymond Lee, leading Adrian Berry, instructed by Stephanie Hill at Leigh Day.
