High Court Grants Sanjay Bhandari Permission to Appeal Extradition Decision

On 14 March, the High Court granted Mr. Sanjay Bhandari, a consultant in the defence sector who is wanted in India on alleged tax evasion and money laundering charges, permission to appeal against the decision of District Judge Snow to send his case to the Secretary of State for the Home Department.

Having been granted permission to appeal on the papers on challenges under Articles 3, 5 & 6 European Convention on Human Rights (ECHR), Mr Bhandari was successful in his renewed application to appeal the decision on the grounds that DJ Snow was wrong to conclude the offences are extradition offences, there was sufficient evidence to make out a prima facie case and there was no real risk of a violation of article 5 ECHR due to a presumption against bail.

The case will now proceed to a four-day substantive hearing at the Royal Courts of Justice later this year.
