On Monday 14 May 2018, an employment tribunal ruled that junior doctors in the NHS who undertake postgraduate training should be covered by whistleblowing protection on the basis that they are ‘workers’ under the Employment Rights Act 1996, s 43K(1)(a). This claim was brought against Health Education England by Dr Christopher Day to establish statutory protection for all junior doctors.
