Court of Appeal Upholds National Disability Strategy Appeal


The Court of Appeal has handed down judgment In R (Eveleigh) v. Secretary of State for Work and Pensions [2023] EWCA Civ 810. The Court upheld the Secretary of State’s appeal against the decision of Griffiths J that the National Disability Strategy was unlawful, holding that the Judge was wrong to conclude that the UK Disability Survey was a voluntary consultation to which the Gunning obligations applied.
