Court of Appeal dismisses appeal in X passport case

The Court of Appeal found that the refusal of the Secretary of State for the Home Department to allow the appellant to apply for or be issued with a passport with an “X” marker in the gender field, indicating gender “unspecified”, does not breach ECHR, articles 8 and 14 and is lawful.

Sarah Hannett, led by Sir James Eadie QC, appeared on behalf of the Secretary of State in R (Elan- Cave) v SSHD [2020] EWCA Civ 363.
