Commercial Court Dismisses Jurisdiction Application in Team Move Damages Claim

In a judgment handed down today, the Commercial Court (Richard Salter KC, sitting as a Deputy Judge of the High Court) has dismissed an application by Dr Perrin for a declaration that the State Court of Dubai is the appropriate forum for Roland Berger’s damages claim.

Roland Berger Limited pursues a claim for damages against Dr Perrin in respect of his alleged participation in a team move of 24 employees of the Roland Berger Group to a competitor, Kearney in the Middle East.

The Court held that the application failed in limine because Dr Perrin had failed to establish that the State Court of Dubai is an available forum having competent jurisdiction in relation to the claims against him. Further, and in any event, the State Court of Dubai was not clearly or distinctly more appropriate than the Commercial Court in London for resolving the dispute to the extent that it involves Dr Perrin.

The claim now proceeds to trial.
