Claire Darwin successful in state immunity claim in Employment Tribunal


The Republic of South Africa’s claim of state immunity has been upheld by Central London Employment Tribunal. This is one of the first state immunity cases to be heard since the Supreme Court’s judgment in Benkharbouche, and concerns the status of staff who work in the administrative and technical service of a mission.

The Republic of South Africa was represented by Claire Darwin, instructed by Sheridans.
