Claire Darwin successful in landmark education discrimination appeal

The Upper Tribunal has handed down judgment in The Proprietor of Ashdown House School v JKL & MNP HS/1322/2019. The Upper Tribunal held that the First-tier Tribunal did have jurisdiction to make an order compelling Ashdown House School to reinstate a pupil that they had unlawfully excluded (a “reinstatement order”), and that the High Court has the power under its inherent jurisdiction to enforce such an order.
Claire Darwin represented the successful Respondents, the parents of the child in question.
