In Jallali v The Commissioner of Police of the Metropolis and The Secretary of State for the Home Department, the Employment Appeal Tribunal (EAT) considered the arrangements for the calculation of salary and the accrual of leave entitlement to part-time police Inspectors.
The EAT held that the Ministerial Determinations, or Annexes, made by the Secretary of State for the Home Department pursuant to her powers under The Police Regulations 2003, when properly construed and applied, did not operate less favourably for a part-time police Inspector than for a full-time police Inspector. Accordingly, the appeal against the Secretary of State did not succeed. Claire Darwin KC acted for the Secretary of State, instructed by the Government Legal Department.
