On 9 March 2021 Swift J granted Fair Play for Women an interim order requiring the amendment to the guidance to the question on the Census 2021, concerning sex. The Judge ordered that the guidance make clear that responders should reply according to the sex on their birth certificate or gender recognition certificate. The ONS has now conceded the claim.
