Alex Bailin QC and Aaron Watkins in first successful forum bar extradition case

In Lauri Love v USA the Lord Chief Justice and Ouseley J today refused to permit Lauri Love’s extradition to the USA on serious computer hacking charges. It is the first case in which the ‘forum bar’ in the Extradition Act 2003, inserted after Gary McKinnon’s case, has successfully prevented extradition. The judgment also contains guidance on the proper approach to be adopted in forum bar cases.

Alex Bailin QC and Aaron Watkins were instructed by Liberty, who intervened in the case.
