Variation of Petroleum Exploration and Development License was lawful

The application for judicial review sought an order to quash a deed which varied a Petroleum Exploration and Development License granted under the Petroleum Act 1998, s 3. The Court held that the grant of a license was not exclusively governed by the statutory code but rather it was a grant of exclusive property rights to search for and get petroleum. The application was dismissed on the grounds that the deed of variation was not ultra vires.
