The Home Secretary had acted unlawfully in failing to recognise an asylum seeker as a victim of trafficking

The Ethiopian national claimant challenged the decision of the defendant that there was no reasonable grounds to consider that she had been a victim of trafficking. Held: Judicial review allowed. The defendant had failed to consider whether the claimant had been harboured by coercive means, in line with the Council of Europe Convention on Action against Trafficking, and had not followed its own guidance on identifying trafficking victims.
