Segregation of male and female pupils amounted to discrimination

Re: HM Chief Inspector of Education, Children’s Services & Skills v Executive Board of Al-Hijrah School [2017] EWCA Civ 1426

Appeal considered whether the segregation of male and female pupils over a certain age for a mixed-sex school amounted to discrimination. The Court unanimously allowed the appeal and held that the policy of strict segregation resulted in detriment and less favourable treatment for both male and female pupils.

Helen Mountfield QC, Sarah Hannett, Dan Squires QC, Karon Monaghan QC and Aileen McColgan were involved in this case.
