Secretary of State reasonably believed that realistic prospect of deportation


Re: R (Botan) v Secretary of State for the Home Department [2017] EWHC 550 (Admin)

Somalian national applied for judicial review of the Secretary of State’s decisions detaining him pending deportation. The claimant argued that there had been no realistic prospect of an enforced removal to Somalia due to the lack of cooperation by Somalia authorities, and thus there was no realistic prospect of detaining him within a reasonable period. The application was dismissed.
