The authorities sought the extradition of the respondents to face trial on charges arisen from the 1994 Rwandan genocide. The Court concluded that there was a real risk of a flagrant denial of justice if the respondents were returned to Rwanda and there was a real risk that innocent men would be wrongly convicted.
