Prospect of rehabilitation relevant to deportation decision


Re: Secretary of State for the Home Department v Dumliauskas & Ors [2015] EWCA Civ 145

The Secretary of State appealed against decisions of the Tribunal refusing the deportation of three foreign criminals because they had better prospects of rehabilitation in the UK. Held: allowing the secretary of state’s appeal, the relative prospects of rehabilitation of foreign criminals in the UK or in their country of nationality were relevant to a deportation decision, but the tribunal erred on the amount of weight to be placed on this factor.
