Judicial review proceedings concerning planning permission granted by the defendant minerals planning authority. The Court held there was no evidence to suggest the defendant’s planning committee had been misled or wrongly advised. In regards to whether matters should have been left for the Environment Agency and Health and Safety Executive, it stated that the defendant had the authority to exercise its discretion to address the concerns themselves.
