No ECHR violation where transgender woman recorded as father on birth cert

Re: JK v Registrar General for England and Wales [2015] EWHC 990 (Admin)

The Court dismissed a challenge by a transgender woman awaiting a gender recognition certificate to the requirement that she be recorded as “father” on the birth certificates of her children. It stated that it did not consider the birth registration scheme to be in breach of the ECHR, arts 8 or 14. While art 8 was engaged, any interference was justified. The children were entitled to have the identity of their biological father recorded.

Daniel Squires QC and David Wolfe QC were involved in this case.
