Published:

Re: Bright & Anor v The Secretary of State for Justice [2014] EWCA Civ 1628

Both of the appellants were serving prisoners and both were in a committed relationship with fellow prisoners. In both cases the respondent took the decision to separate each appellant from his respective partner. The appellants alleged that the separation was a violation of ECHR, art 8. Held: the respondent’s decisions were in accordance with the ECHR, art 8 and the appeals were dismissed.

Hugh Southey QC was involved in this case.
