Whether the Council had acted contrary to ECHR, art 3 and the Children Act 1989, where a child, TG, with serious behavioural issues, and his siblings were said to be at risk of harm as a result if his disorder. Whether the Council had erred in deciding that TG had moved out of its local authority area, and was no longer its responsibility. Held: The defendant had acted unlawfully and its decision regarding relocation was quashed.
