The Lord Chief Justice and Ouseley J today refused to permit Lauri Love’s extradition to the USA on serious computer hacking charges. It is the first case in which the ‘forum bar’ in the Extradition Act 2003, inserted after Gary McKinnon’s case, has successfully prevented extradition. The judgment also contains guidance on the proper approach to be adopted in forum bar cases.
