The application for judicial review challenging the removal of certain categories of prison law from the scope of criminal legal aid was partially granted. The Court concluded that the high threshold required for a finding of inherent or systematic unfairness had been satisfied in the case of pre-tariff reviews by the Parole Board, category A reviews and decisions as to placement in a CSC.
