Re: Kenny Johnston v Giving.com Limited, Case No 226MC647 (2nd November 2022)

When Giving.Com Limited provided services to registered charities and non-profits, including a charity run by the Claimant, it was not acting as a service provider for the purposes of s29(1) of the Equality Act 2010. Those services were not services to the public or a member of the public within the meaning of s29(1) EA 2010. Accordingly, the Claimant’s claims against Giving.Com Limited were outside of the scope of Part 3 of the Equality Act 2010.

Claire Darwin and Roisin Swords-Kieley represented the defendant in this case.
