The first interested party was subject to an EAW and sought to resist the warrant on the ground that prison conditions in Italy are so bad as to breach ECHR, art 3. Held: dismissing the appeal, despite problems with Italian prisons, given the high threshold of ECHR, art 3 there were not substantial grounds for believing the first interested party’s rights under ECHR, art 3 would be breached.
