Evidence of torture created risk that claimant’s detention was unjust

Re: R (Abdulrahman Mohammed) v Secretary of State for the Home Department [2016] EWHC 447 (Admin)

The court granted interim relief, including conditional bail, where there was independent evidence that the Somali claimant, detained pursuant to a deportation order, had been tortured. Detention of torture victims required exceptional circumstances. In this instance, the strength of the claimant’s claim and the risk of injustice justified interim relief.
