Diplomatic assurances made extraditions to Hungary ECHR compliant

Re: GS & Ors v Central District of Pest Hungary & Ors [2016] EWHC 64 (Admin)

The appellants challenged their extradition to Hungary, arguing that it was contrary to ECHR, art 3 and Extradition Act 2003, s 21. The court had to determine whether assurances provided by the Hungarian authorities that each of the appellants would enjoy sufficient space if incarcerated could be relied upon to negate the real risk of treatment contrary to art 3. Held: The assurances could be relied upon. Appeal dismissed.
