Defective decision to recategorise prisoner as high risk allowed to stand

The claimant was a “category A” prisoner. The claimant sought a judicial review of the decision to categorise him as a high escape risk. Held: the defendant’s decision was held to be defective but owing to the unusual facts of the case the defective decision was allowed to stand.
