Court upholds right of Zambian citizens to bring claims against mining companies

Re: Lungowe & Ors v Vedanta Resources Plc & Anor [2017] EWCA Civ 1528

Vedanta Resources Plc and KCM applied for a declaration that the Court did not have jurisdiction to try the claims of Zambian citizens in relation to the personal injury, damage to property and loss of income, amenity and enjoyment of land claims, resulting from alleged pollution and environmental damage caused by discharges from the Nchanga cooper mine. The appeals were dismissed.

Richard Hermer QC and Edward Craven were involved in this case.
