Court upholds decision of University’s Fitness to Practice Panel to terminate student’s medical studies


Re: Thilakawardhana v Independent Adjudicator for Higher Education [2018] EWCA Civ 13

This case considered a judicial review claim arising out of a decision by the University’s fitness to practise appeal panel to terminate the registration of a medical student.

The Court of Appeal gave important guidance on the approach that courts should adopt to the decisions of fitness to practise panels, fitness to practise appeal panels, and the Office of the Independent Adjudicator.
