These proceedings related to allegations by Peruvian citizens that they had been injured by members of the Peruvian National Police during a protest at the Tintaya mine in Peru. It was common ground between the parties that the applicable law for the claims was Peruvian law by virtue of the provisions of Rome II and the issue before the Court was whether the claims were time barred by Peruvian law.
