Court refuses to strike out claim of trafficking victim

Re: PP v the Home Office & Anor [2017] EWHC 663 (QB)

Claim alleged the failure to make reasonable enquiries as to whether the claimant was a victim of trafficking in breach of the investigative duty imposed by the ECHR, art 4 and also unlawful detention as a consequence of alleged errors of law relating to the identification of the claimant as a victim of trafficking. The Court refused to strike out the false imprisonment claim and refused to strike out the ECHR, art 4 claim.
